The User agrees to pay AbhiCure for the e-consultations completed in accordance with the terms of this Agreement. AbhiCureshall share a receipt with the User at the time of booking of an appointment or before beginning a consultation after the execution of the consultationand the Client shall in advance, make payment of platform usage charges that could be incurred by AbhiCure in delivering the e-consultation, in the form of a cheque/wire transfer.

In any event if the User is unable to avail the E-Consultation Services from the Registered Medical Practitioner or if the User wishes to cancel the appointment, User shall be entitled to do so by choosing the respective option on the AbhiCure Platform. If User does not avail the Services or cancels the E-Consultation, the Services Fees will be refunded to the User as per the Refund Policy in the same manner of payment in which the User has paid the Service Fees. However, if the User refuses to take the call when the Registered Medical Practitioner calls the User or cancels the appointment one hour before the scheduled time, the User will not be entitled for any refund. Any issues regarding payments made, refunds claimed or otherwise error in the transactions shall be reported to AbhiCure at the customer care specified on the AbhiCure Platform.

CANCELLATION POLICY:

In case of cancellation or non-confirmation of the appointment by AbhiCure due to any reasons, the following options are available to the User:

  • He/she may ask for rescheduling the appointment with the specialist doctor.
  • He/she may claim a refund of the advance payment.
  • The advance payment may be added as credit in the AbhiCure Wallet of the User and be adjusted in due course for future consultations.
  • In case the User misses or cancels the appointment, he/she shall not be entitled to any refund.
  • In case the User's credit card/debit card/payment account has been accidentally overcharged, please notify AbhiCure of the same at the earliest. In case of over-charging, the User has the following options:
  • He/she may claim a refund of the outstanding amount. In such a scenario, AbhiCure shall make all endeavours to refund the amount within 7-14 working days. The outstanding amount may also be credited to the AbhiCure Wallet of the User so as to be adjusted in future consultations of himself or of any other person.
  • The refund shall be made by e-banking or by demand draft or by other such mode other than cash, depending upon the suitability of both, AbhiCure and the User.
  • For claiming refund, the User should necessarily have the valid invoice of theinvestigations, so as to be able to get the refund.

REFUND POLICY:

AbhiCure will not, under any circumstances, issue cash refunds or credits for early contract cancellation or refund payment for any consultation, once charged. In case of any questions about charges made to your account, kindly contact support@abhicure.com immediately. Even if the charges were made in error, AbhiCure still has the sole discretion to credit the account or credit card account for the appropriate or corresponding amount. AbhiCure has a zero-tolerance policy for chargebacks. Any chargebackfees, past due fees and costs will be sent to collections.

If AbhiCure’s collection efforts fail, unpaid debts will be reported to all available credit reporting agencies. Booking and cancelling a consultation within 24 hours at any particular point of time will not allow refund of the Consultation fees.

AbhiCure shall issue a full refund after the moderation team does an internal enquiry (after complaint registration) to check the quality. However, the decision to refund vests with AbhiCure.

The User expressly agrees that the exclusive jurisdiction for any dispute with AbhiCure, or in any way relating to use of the Site, resides in the courts of Kolkata, West Bengal, India. The User further agrees and expressly consents to the exercise of personal jurisdiction in the courts of Kolkata, India in connection with any such dispute including any claim involving AbhiCure or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers, and content providers.

The User understands that these Terms and Conditions are governed by the internal substantive Indian laws, without respect to its conflict of laws principles. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any of these Terms at any one point of time shall be deemed as a further or continuing waiver of such term or condition or any other term or condition in a subsequent occasion.

AbhiCure reserves the right to place any third party advertisements on the Site at any time and without notice or consent and without attracting any liability in this regard. AbhiCure reserves the right to charge the Users in the future with prior notice. AbhiCure reserves the right to limit account holders use of AbhiCure Accounts. Questions or comments regarding the Site should be directed by electronic mail to support@abhicure.com.

The contents on the portal are provided by AbhiCure for use by the online users as a quick reference of information about doctors, other healthcare services providers, Diagnostic Labs and medicines. The listing of the doctors, other healthcare services providers, Diagnostic Labs and other pharmacies on the portal is not intended as a tool for verifying the credentials, qualifications, or abilities of any person or organization. Inclusion in the Directory Listing does not imply recommendation or endorsement nor does omission in the Directory Listing imply AbhiCure disapproval. The Registered Medical Practitioners in AbhiCure medical panel are board certified practitioners (Registered Medical Practitioners)in their respective Countries.

Any information provided by AbhiCure employees including the practitioners on helpline (video consulting, Live Chat and Email) provided to the User to make a more informed decision. AbhiCure will not be responsible or liable in any manner whatsoever for any damages or any loss (including that of health, life, limb or livelihood) of any kind because of following the advice or instruction given by AbhiCure employees, owners, directors, doctors, moderators, associates, contractors and online users.

Refund In case of Prescription Orders:

At Abhicure.com, we strive to ensure your orders are delivered to your satisfaction. However, in the rare event that your order is unsatisfactory, we are happy to accept returns for orders, if:

  • you’ve received an item(s) that does not match your order
  • the item(s) were damaged in transit or shortage (delivery of such order to be refused at doorstep)
  • the item(s) is due to expire within 3 months where the shelf life of the item is more than 3 months
  • the patient has developed any allergies after taking the medication and the doctor has prescribed another medicine, the medicines can be returned within thirty (30) days from the date of delivery.

Note: If you notice the package is damaged at the time of delivery, please do not accept the order. If you could not check that the order is damaged at the time of delivery, raise a return request within 24 hours of delivery by contacting us at support@abhicure.com Replacement for the damaged item (s) is subject to availability in stock. In absence of a replacement, a refund will be issued.

Returns are subject to the following conditions:

  • Items being returned should only be in their original manufacturer’s packaging i.e. with labels, bar-code.
  • Only fully unused strips/bottles can be returned
  • Batch number of the product being returned should match as mentioned on the sales invoice
  • Original sales invoice has to be returned for processing returns and refunds.

We do not accept returns in following scenarios:

  • Partially used strips, opened bottles cannot be returned.
  • Products which require specific storage conditions (temperature controlled) cannot be returned (vials, injections, vaccines, penfills, etc.)
  • Products which have expired post purchase.
  • Second time request against the same product/order.

Return Process:

If your order is suitable for a return based on the conditions above, you can raise a request within thirty (30) days from the date of delivery. Please note that all returns are reviewed for eligibility. All refunds are subject to the verification and review by our Returns team.

Refunds for Lab Services:

If you’ve placed an order for our lab/diagnostic services, you may cancel it anytime two hours before your scheduled sample collection. If payments are directly made to the service providers for diagnostic purposes, any claims that arise must be made to the chosen service provider, as AbhiCure and its representatives are only facilitators.

If you’ve made a payment to abhicure.com, refund will be processed for requests raised with three (3) days of order or request is placed.

Returns and Refunds for Third Party Affiliate Orders:

Return and refund requests for orders placed by our third-party affiliates will be addressed by the respective affiliate. Please contact them for any claim that may arise. AbhiCure will not be liable for refunds for the payments initiated through third party affiliates.

Refunds timeline:

Refunds for all eligible Returns are issued through the payment method used at the time of purchase, except for Cash on Delivery.

The time frame for different payment modes is given below:

* Refund timelines depend on bank turnaround times and RBI guidelines. This may change from time to time. Business days shall mean the working days on which AbhiCure corporate office operates.

General:

  1. Manufacture Warranty (where applicable for devices/instruments) – If the returns of the products are arising from a warranty provided by manufacturer, please direct your returns to the manufacturer. AbhiCure takes no responsibility for the warranties provided by the manufacturer and such products does not fall within the ambit of the return policy.
  2. Liability- Maximum liability for any wilful delay caused by AbhiCure, shall be limited to the actual sale consideration received by AbhiCure or the amount refundable to customer, whichever may be lesser.
